| NORTHLINK SAY TUPE TRANSFER REGULATIONS DO NOT APPLY | |
| 19 August 2002 NorthLink Orkney and Shetland Ferries Ltd have informed P & O Scottish Ferries and staff representatives that it is the company’s view that TUPE regulations will not apply when P & O staff transfer to the new operation on October 1. NorthLink will offer some 230 P & O seafarers employment on the same terms and conditions that they currently enjoy with P & O. In addition, a further 20 passenger reservation staff will be offered employment within the new NorthLink customer service operation. The company has consulted widely with staff and the RMT and Numast unions and has taken legal advice. The outcome of these discussions has led NorthLink to the view that the Transfer of Undertakings (Protection of Employment) Regulations will not apply when the NorthLink service commences on October 1. | |
